CHB Communication Privacy

We respect your right to privacy, particularly when communicating with our Sennheiser Consumer Hearing Business. As used here, “CHB”, “we”, “us” or “our” means Sonova Consumer Hearing USA, LLC and Sonova Consommateur Audition Canada Inc. and, where appropriate, its affiliates, licensors, subsidiaries, and/or related companies.

This notice applies solely to information that CHB collects and uses in connection with the telephone, email, text message, letter, or other methods of communication we utilize in the United States. Information We Collect in Communicating With You

When you visit the Sennheiser Consumer Hearing website you may choose to share certain contact Information with us, including: first name, last name, physical address, email address, and phone number (collectively, “Contact Information”). We may collect this information as part of processing and following up on your order, or we may collect it affirmatively (e.g., when you sign up for an email newsletter).

We use this Contact Information to:

(i) send transactional, promotional, or informational messages via email, phone or physical mail;

(ii) respond to your inquiries and support requests; and

(iii) to comply with applicable legal and regulatory requirements.

If you do not want to receive such communications from us, please contact the Data Privacy Officer as detailed below or by using the opt-out facilities provided within the relevant marketing material.

Your option not to receive promotional and marketing material: (a) shall not preclude us from corresponding with you, by email or otherwise, regarding your relationship with us; (b) shall not preclude us from accessing and viewing your Contact Information for our internal business purposes; and (c) shall not preclude us from disclosing your Contact Information as described in this Policy for purposes other than sending you promotional and marketing materials.

We do not sell or share your Contact Information with third parties for cross-context behavioral advertising; additionally, we do not currently share the personal information of minors and do not have actual knowledge that we share the personal information of minors.

In line with our Global Privacy Policy, we may share the Contact Information within our Sonova Group Companies, which includes all Sonova subsidiaries and affiliates. Additionally, we may share the information we collect with companies that provide support services to us (such as email providers, mobile marketing services, analytics providers, web hosting providers, call center providers, etc.) that help us provide our services or market our products.

Additionally, CHB and its contractors or affiliates may process or host personal information using databases and IT systems located outside of Canada, including the United States and Europe. In that context, personal information may be subject to access requests from foreign governments, courts, law enforcement officials and national security authorities, according to foreign law.

See “Text Message Terms and Conditions” below for SMS and MMS messages specifically. Please be aware that text messages are not encrypted. They can be accessed and read by anyone with access to messages on your mobile device. You should use a password on your mobile device to be sure you are the only person that can see your text messages.

While browsing this website or completing an order, we may also use device identifiers, cookies, and other technologies to collect technical information. For more information about this, please refer to “Cookies and Other Tracking Tools” in our Global Privacy Policy.

Privacy Rights Related to Personal Data

CHB takes your privacy and the protection of your personal information seriously. If you wish to opt out of any particular communication channel, you may reach out to us via support ticket or privacy@sonova.com. Additionally, you have the ability to unsubscribe from texts by responding ‘STOP’ or opting out of further emails via the unsubscribe link included in each email.

  • Have us delete personal data concerning you;
  • Correct inaccuracies, taking into account the nature of the data collected and the purposes of the processing of your personal data;
  • Opt out of the processing of your personal data for specific purposes, such as targeted advertising; and
  • Confirm whether we are processing your personal data, and be provided a copy of that data.

To exercise the rights described above, please submit a request to us by contacting privacy@sonova.com. We may require you verify your identity before fulfilling your request. If a determination is made that we cannot act on your request, we will notify you of this decision in the appropriate time.

Text Message Terms and Conditions

Individuals may sign up to receive recurring, marketing SMS and MMS text messages (“Texts”) from CHB, subject to the following Terms and Conditions (“Terms”). Texts may include promotional alerts, new product information, and other content. By signing up to receive Texts, you agree to our Privacy Policy and to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. THESE TERMS AFFECT YOUR LEGAL RIGHTS, INCLUDING BY LIMITING CHB’s LIABILITY AND WAIVING YOUR RIGHT TO ASSERT CLAIMS ON A CLASS OR COLLECTIVE BASIS.

1. You may opt in to receive recurring promotional Texts from CHB in various ways, including by submitting your information through an online form, or by texting “YES” to any inbound prompt.

2. By signing up to receive Texts, you certify that you (1) are at least the age of majority in the jurisdiction in which you reside, (2) are the account holder of the mobile number you are enrolling, and (3) agree to these Terms.

3. Autodialer or non-autodialer technology may be used to send Texts to the mobile phone number you enroll.

4. You understand that you are not required to consent to receive marketing Texts as a condition of purchasing any goods or services.

5. Although Texts are complimentary, message and data rates may apply. Depending on your data plan, your carrier may charge you to receive Texts.

6. Generally, you will receive up to 5 Texts per month per subscription, but the number of Texts you receive may vary depending on your interactions with us.

7. You can stop receiving Texts at any time by replying “STOP” to any Text you have received.

8. You agree to provide accurate, complete, and up-to-date information when you sign up for Texts, and that you will notify us immediately at privacy@sonova.com if you cease to be the account holder.

9. CHB does not guarantee the performance or availability of text messaging services and is not responsible for delayed or undelivered Texts.

10. CHB Texts may not be available in all areas or supported by all carriers. Participating carriers include: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Alaska Communications Systems, Appalachian Wireless, Bluegrass Cellular, Cellular One, Cricket, Coral Wireless, COX, Cross, Element Mobile, Epic Touch, GCI, Golden State, Hawkeye, Illinois Valley Cellular, Inland Cellular, iWireless, Keystone Wireless, Mosaic, Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau, Revol, RINA, Simmetry, Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central.

Carriers are not liable for delayed or undelivered messages.

Dispute Resolution / Class Action Waiver

In the unlikely event that a disagreement arises between you and CHB with respect to the Texts or these Terms, please first contact CHB directly by opening a support ticket here, or calling +1-860-598-7830.

These Terms shall be governed by, construed, and enforced in accordance with local State laws. You agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Texts or these Terms, shall be resolved individually, without resort to any form of class action. You agree to submit to the personal jurisdiction of the courts of the State of Illinois for any cause of action arising out of these Terms.

Updates to this Policy

We may update this Policy from time to time in order to reflect new or different privacy practices. In this case, we will post updated versions of this policy on this page.
